California prepares an AI "kill switch": recommendations due by November 16
On September 18, 2026, California Governor Gavin Newsom signed Executive Order N-9-26. The state proposes requiring frontier-model developers to create a rapid shutdown mechanism whose operation would be continuously tested by an independent organization. Auditors would also be able to regularly review companies’ safety frameworks, transparency reports, and risk assessments.
In 2024, Newsom vetoed SB 1047, which would have required external audits and the ability to quickly shut down large AI models. Now the state is returning to the same idea by drafting new rules. The order itself does not require companies to install a “kill switch”: the Government Operations Agency and Office of Emergency Services must submit recommendations for legislative changes by November 16, 2026.
By November 16, 2026, the state is set to receive recommendations for strengthening its AI laws.
